These Terms and Conditions govern the use of REPUSEL Online Service (the Service) including shopping and participation in promotions run by REPUSEL. Manufacturer’s Warranty

Products and services are the responsibility of the manufacturer or provider of those services and are covered by the warranties offered by such manufacturers or service providers. Supply for Business Purposes

The Purchaser agrees that where all Products are acquired for the purposes of a business the Consumer Guarantees Act 1993 will not apply.

Purchaser’s Right to Compensation

If the REPUSEL is responsible for any Products being defective or not materially conforming to REPUSELs’ description, REPUSEL will at its option:

  • Repair or replace the defective products or re-perform the service; or
  • Pay compensation to a maximum amount that does not exceed the purchase price for the defective products.
    This is the purchaser’s sole right for compensation from REPUSEL

Product Ratings & Reviews

The REPUSEL Ratings and Reviews feature allows you to rate products (using a 1-5 star system) and/or write a product review based on your personal experience with that product. Reviews and Ratings are screened and filtered for profanity, violence, illegal activities or inappropriate material. Approved product ratings and reviews are posted on the product detail page of the product it is referencing. Product ratings and reviews should be made only by individuals who have actual experience with the product. REPUSEL employees, contractors, vendors, board members, investors and any other individual with a vested interest in REPUSEL are strongly discouraged from submissions. Approved ratings and reviews will remain visible on the Site product page as long as the product is presented online. REPUSEL does not endorse any ratings provided on the Site. The availability of our products may change without notice.

You may order Products by selecting and submitting your order through the Site in accordance with these Terms and Conditions. Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges and taxes) at the time you place the order. We will charge you, and you agree to pay, price, fees and charges in relation to an order that we accept (as applicable): the purchase price of each Product that is ordered; the delivery fee for delivering the Products to you; and any other fees and charges set out in these Terms and Conditions (as applicable to the Product offered). We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site. You agree to provide us with current, complete and accurate details when asked to do so by the Site.

Acceptance & Rejection of Order

Your order is not binding until accepted by REPUSEL. This offer may be accepted or rejected by REPUSEL for any reason, including, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. Each order placed for Products through the Site that we accept results in a separate binding contract between you and us for the supply of those Products. For each order accepted by us, we will supply the Products in that order to you in accordance with these Terms and Conditions. Your contract with REPUSEL will only come into existence when you have fully paid for your order and REPUSEL provides confirmation that your order has been accepted.

Confirmation will be sent via email to your elected email address. If we reject an order placed through the Site, then we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.

Cancelling an Order

We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

  • the requested Products in that order are not available; or
  • there is an error in the price or the product description posted on the Site in relation to the relevant Product in that order; or
  • that order has been placed in breach of these Terms and Conditions.

If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order if we cancel it before the delivery date or if you are not at fault or in breach of these Terms and Conditions.

Pricing

The purchase price of each Product is shown on the product list on the Site at the time you place your order. We will charge you, and you agree to pay, the following fees and charges in relation to an order that we accept (as applicable): the purchase price of each Product that is ordered; the delivery fee for delivering the Products to you; and any other fees and charges set out in these Terms and Conditions.

All prices shown are in the currency of the country demonstrated and or selected by you at the time of use and purchase. All fees and charges identified in these Terms and Conditions and all prices for the Products as shown on the Site display the inclusiveness of GST and any other sales tax (unless otherwise indicated). All prices shown on this Site for Products, Delivery and other charges displayed on this site are current at the time of issue. Please note that we reserve the right to alter prices at any time for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.

Title, Risk and Delivery

All Products are at the Purchaser’s risk: for other Products, from the point of loading onto the carrier or being made available for uplifting by the Purchaser, whether or not the Purchaser takes delivery of them at that time.

When delivery is included in the price, Products are at our risk until delivered to you, or in the case of an off shore island address, until delivered to your shipping agent.

Ownership of the Products in an accepted Order remains with us until, and will only pass to you when, you have paid us in full for those Products.

Delivery time is subject to stock availability. Please note that dates given for delivery are a best estimate and are given in good faith but are not to be treated as a condition of the sale. No claim shall be made by you on account of late delivery however caused. Late delivery shall not constitute a breach of this contract by us, and you shall not be entitled to cancel the contract because of late delivery.

Delivery fees are payable in addition to the purchase price of each Product. A number of different delivery methods may be used depending on the type of order. Delivery fees are based on the order value as follows. You acknowledge and agree that you may incur additional delivery fees/freight charges (in excess of the fees and charges specified above) for: special, non-stock and/or bespoke items; heavy, bulky and/or awkward items; express or urgent deliveries; or bulk or large quantity orders.

Delivery charges are based on the weight and size measurements of the product purchased. Delivery charges will be added to your order at the rate calculated at Checkout. Delivery charges are calculated and shown as a separate item before you choose to enter your payment details and send the order to be processed.

We may include delivery costs into package deals, and the delivery costs will not be demonstrated.

Delivery is by carrier, products will not be delivered to an unattended address. To ensure successful delivery, please provide a delivery address where someone will be present during business hours to sign for the receipt of your package. The REPUSEL will notify you of actual delivery time. The carrier requires a signature from an occupant at the specified delivery address. If no one is available to sign for the products, the products will be re-directed to the nearest carrier depot. The customer is then responsible for collecting the parcel from that depot or paying an additional charge for re-delivery. REPUSEL currently ships within New Zealand and Australia and to physical addresses only. You can track your order by entering the tracking number emailed to you in the dispatch email. If your are wishing to purchase REPUSEL products outside of New Zealand or Australia please contact REPUSEL using the Contact Us form on this web site, we look forward to your message.

We may deliver each item ordered separately if we chose for supply or other reasons. If this is the case you will not incur any extra delivery cost.

If we cannot provide the agreed quantity of Products for any reason outside its reasonable control, we are not liable for that shortfall and the Purchaser must take delivery of and pay for the lesser quantity we are able to supply.

In the case of delayed delivery REPUSEL will contact you, the buyer, and inform you of the general date of availability.

You represent, warrant and covenant that the items you purchased pursuant to these Terms and Conditions will not be exported, re-exported, or transferred out side of New Zealand.

Refund & Return Policy

Once the payment is confirmed, your order cannot be cancelled and refunded.

REPUSEL retains the right to replace in any instance, of faulty, damaged and wrong item sent.

Refunds

We will provide a full refund if: The item is found to be defective and we are unable to fix or replace it, the item was incorrectly described in the website listing. The refund will include your Handling and Shipping costs. Refunds will be credited against your original method of payment excluding delivery costs. Under the Consumer Guarantees Act you are entitled to have your product repaired, replaced or refunded.

Returns

Damaged upon arrival

You must contact us as soon as possible upon receiving your item. Please email us with a photo that clearly shows the product’s damage. We will send you a replacement and we will arrange a Carrier pick up of the damaged item for a damage assessment. You will be informed of a time for the pick-up. Please leave the item in front of your door if no one at home when carrier driver pick up the item and also please put the item back to its original package as Carrier will need to see how the item was packed and then determine whether our claim will be approved!

Received incorrect items

We are extremely sorry about our mistake and for any inconvenience this might have caused. Please email us a picture of the order you had received to: sales@repuseltowmirrors.com will arrange for a prepaid carrier ticket to be sent to you by mail, to return the item to us on our cost. We will dispatch the correct item as soon as we receive your returned product. You will receive a small gift as a offer of our good will to you. For larger items a REPUSEL representative will call on you to inspect the goods.

Items missing from your order

You must report it to us at sales@repuseltowmirrors.com within 5 working days of receiving your order, we will interview the packer at our warehouse first and send you the missing item if it is proved to be our mistake. We bear no responsibility for items not reported as missing in the five working days following delivery. Please note that if you have ordered multiple items from us, orders may have been combined into the same box, so please check packages thoroughly before progressing. Occasionally orders may be shipped as separate packages, the boxes will be labelled, if any boxes are missing from your delivery please contact us immediately.

Faulty Products

All products supplied by REPUSEL are vigorously tested to international standards. However, as with any mass produced products, there will always be the probability that a tiny percentage may exhibit a fault, which is why we provide a full 12 month warranty on all goods.

Contact us within the warranty period if you encounter any problems associated with the product. We will arrange a pre-paid carrier ticket for you to return the item to us for testing. Upon return REPUSEL or the local distributor/manufacturer will repair or replace damaged or faulty goods. If the product cannot be repaired or exchanged for a same or similar item, a full refund (including shipping) or store credit will be provided.

Return Times

Please allow up to 10 working days for the returning to be processed and further 5 working days for testing and/or repair of the item(s). We bear no liability for damage caused by inappropriate return of the item(s). Please ensure items are fully protected and secure in the packaging. All warranties are considered void in the case of unauthorized repairs. If items returned to us as faulty are found to be in full working order upon testing, you will be liable for any extra shipping costs incurred. Please ensure that you have explored possible options such as flat batteries before returning the item to us. Refunds will be processed via the method of payment, please be aware that bank clearance times vary and there may be some delay before funds appear in your account.

Include a copy of your original invoice and reason/s for the return.

General Provisions

Terms

Each term of these Terms and Conditions is separately binding. If the whole or any part of a term of this agreement is void, or for any reason unenforceable or illegal in a jurisdiction it is severed for that jurisdiction, all other terms remain effective and binding. This clause has no effect if the severance alters the basic nature of this agreement or is contrary to public policy .If we do not exercise or enforce any right available to us under these Terms and Conditions or otherwise arising at law or in equity, this does not constitute a waiver of those rights.

Jurisdiction & Governing Law

These Terms and Conditions (and the provision of products and services by us) are governed by and to be interpreted solely in accordance with New Zealand law. In the event of any dispute arising in relation to these Terms and Conditions or their subject matter, each party submits to the non-exclusive jurisdiction of the New Zealand.

Dispute

If a dispute arises in relation to these Terms or the supply of Products, a party cannot initiate legal proceedings against the other in respect of the dispute until the party has complied with its obligations in this sub-clause. If such a dispute arises a party may give written notice to the other of the dispute. Within 5 Business Days of receipt of the dispute notice representatives of each party with authority to resolve the dispute will meet and, acting in good faith, attempt to resolve the dispute. If the dispute is not resolved within 10 Business Days of the first meeting, either party may initiate legal proceedings in respect of the dispute. Nothing in this sub-clause prevents a party seeking urgent injunctive relief.

Force Majeure

If a Force Majeure Event occurs which prevents or delays a party performing its obligation(s) under these Terms (except an obligation to pay money), the time for performance of the affected obligation(s) will be suspended for the period of the Force Majeure Event, provided that the party whose obligations are affected by the Force Majeure Event promptly gives the other party written notice of the Force Majeure Event, its expected duration and the affected obligations, and uses reasonable endeavours to mitigate the effects of the Force Majeure Event and to recommence performance of the obligation(s) notwithstanding the occurrence of the Force Majeure Event

Waiver of Rights

A waiver of a right, power or remedy available to a party under these Terms is only valid if in writing and signed by the party giving the waiver. A party does not waive a right, power or remedy available to it if it fails to exercise, delays in exercising or only partially exercises the right, power or remedy. A single or partial exercise of a right, power or remedy does not prevent another or further exercise of that or another right, power or remedy.

Non-Disclosure

A party may not disclose confidential information acquired from the other party without that party’s prior written consent, except where disclosure is required by law.

Novation

Neither party may assign or novate their rights and/or obligations under these Terms without the prior written consent of the other party, except that we may do so without your prior written consent if the assignment or novation is to a Related Company.

Severance

If any clause or part of these Terms is or becomes illegal, invalid or unenforceable, it will be severed from these Terms, and the remainder of these Terms will continue in full force and effect.

Costs

All costs and expenses incurred by us to remedy any breach by you of your obligations under these Terms will be recoverable from you in addition and without prejudice to our rights to damages for your breach.

Communications

Any notice or other communication to be given under these Terms must be in legible written English and must be given or sent to the recipient by personal delivery, by registered mail, by facsimile or by electronic mail to the recipient’s address, facsimile number or electronic mail address on the first page of these terms. A party may vary its details for notices by giving written notice to the other party in accordance with this sub-clause.
